Terms of Use

The rules that govern your use of the Vike Insurance website and our brokerage services. Please read them carefully.

1. Introduction

These Terms of Use (the "Terms") govern your access to and use of the website at vikeinsurance.co.ke (the "Website") and the brokerage and related services provided by Vike Insurance Brokers Limited ("Vike Insurance", "we", "us", or "our").

Vike Insurance is an insurance broker licensed by the Insurance Regulatory Authority (IRA) of Kenya. We arrange insurance cover on your behalf with underwriters; we are not the underwriter of any insurance policy. Where we place cover, the insurance contract is between you and the underwriter, and is governed by the policy wording issued by that underwriter.

By accessing or using the Website or our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Website or our services.

2. Eligibility

You must be at least 18 years of age and have the legal capacity to enter into a contract to use our services. By using the Website, you confirm that you meet these requirements. If you are using the Website on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these Terms.

3. Our Services

The services we provide through the Website include:

  • generating indicative insurance quotes based on the information you provide and information we obtain from third parties (for example, vehicle details from the NTSA / DMVIC register);
  • placing insurance cover with underwriters on your behalf;
  • administering your policy through its term, including renewals and amendments;
  • supporting you with the lodging and follow-up of claims;
  • providing educational content about insurance products.

We act as an intermediary between you and the underwriter. Unless we have expressly agreed in writing to provide advice, the information and recommendations on the Website are general in nature and should not be relied on as personal financial advice.

4. Quotations

A quotation generated through the Website is indicative only. It is based on the information you provide together with information we obtain from third-party sources, and it is neither a contract of insurance nor an offer by an underwriter to bind cover. Cover begins only when an underwriter has accepted the risk, premium has been paid in full or in line with an agreed instalment plan, and a policy document has been issued.

You warrant that the information you provide when requesting a quote is complete, accurate, and not misleading. Insurance is a contract of utmost good faith — providing inaccurate or incomplete information may cause an underwriter to reject a claim, void the policy, or refuse renewal.

5. Your Account

Some of our services may require you to register for an account or client portal. Where you do so, you are responsible for keeping your login credentials confidential and for all activity that takes place under your account.

You agree to keep the information in your account complete, accurate, and up to date. Out-of-date information — for example an expired phone number, email address, or payment instruction — may prevent us from communicating with you about your policy and may affect a claim. If you suspect unauthorised access to your account, please notify us immediately at info@vikeinsurance.co.ke.

6. Acceptable Use

The Website is provided for the personal, non-commercial use of bona fide customers and prospective customers. You agree not to:

  • use any robot, spider, scraper, or other automated tool to access, monitor, copy, or harvest content from the Website;
  • use information obtained through the Website for any commercial purpose, including price benchmarking, market research, or onward resale of quotes;
  • attempt to interfere with the proper operation of the Website, or to bypass any security or access controls;
  • reverse engineer, decompile, or attempt to extract the source code of any software underlying the Website or our services;
  • use the Website in any way that is unlawful, fraudulent, or that infringes the rights of others.

We may suspend or terminate your access to the Website at any time and without notice if we reasonably believe you have breached these Terms.

7. Your Content

In the course of obtaining a quote, taking out a policy, or making a claim, you may submit information and documents to us — for example identity documents, vehicle photographs, medical reports, police abstracts, or valuation reports (together, "Your Content").

You retain ownership of Your Content. You grant us a non-exclusive, royalty-free licence to use, copy, store, and share Your Content with underwriters, reinsurers, loss adjusters, regulators, and other parties to the extent reasonably necessary to provide the services you have requested and to comply with our legal obligations. We handle personal data within Your Content in accordance with our Privacy Policy.

8. Intellectual Property

The Website and all content on it — including the Vike Insurance name and logo, page layouts, text, graphics, images, icons, and software — is owned by or licensed to Vike Insurance Brokers Limited and is protected by copyright, trade mark, and other intellectual property laws.

You may view, download, and print content from the Website for your own personal, non-commercial use. Any other use — including reproduction, distribution, modification, or republication — requires our prior written permission.

9. Third-Party Links

The Website may contain links to third-party websites (for example underwriters, regulators, or partner platforms). These links are provided for convenience only. We do not control those websites and are not responsible for their content, terms, or privacy practices. Visiting a linked third-party website is at your own risk.

10. Disclaimers

While we take reasonable care to ensure that the content on the Website is accurate and up to date, the Website and our services are provided on an "as is" and "as available" basis. To the maximum extent permitted by Kenyan law, we make no warranties or representations, express or implied, regarding the operation, availability, accuracy, or fitness for a particular purpose of the Website or its content.

The terms of any insurance policy you take out — including what is covered, what is excluded, and the procedures for making a claim — are set out in the policy wording issued by the underwriter. To the extent of any conflict between these Terms and the policy wording, the policy wording prevails as between you and the underwriter.

11. Limitation of Liability

To the maximum extent permitted by Kenyan law, we are not liable for any indirect, incidental, special, or consequential loss arising from your use of, or inability to use, the Website or our services — including loss of profits, loss of data, or loss of goodwill.

Nothing in these Terms limits or excludes our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be limited or excluded by law (including under the Consumer Protection Act, 2012).

12. Availability and Suspension

We may, in our sole discretion and without prior notice, suspend or terminate the operation of the Website (in whole or in part) or your right to access or use the Website — for example, for scheduled maintenance, to respond to a security incident, or to comply with a legal requirement.

Suspension or termination of the Website does not affect the validity of any insurance policy you have already taken out, which continues to be governed by the policy wording issued by the underwriter.

13. Privacy

We process personal data in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use, share, and protect your personal data, and the rights you have under the Kenya Data Protection Act, 2019.

14. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them are governed by the laws of the Republic of Kenya. The courts of Kenya have exclusive jurisdiction over any such dispute, save for any non-waivable right you may have to bring a complaint before another forum of competent jurisdiction (including the Insurance Regulatory Authority or the Office of the Data Protection Commissioner).

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page shows when they were last revised. If we make material changes we will post a prominent notice on the Website before the changes take effect. Your continued use of the Website after the changes take effect constitutes acceptance of the updated Terms.
