The Work Injury Benefits Act (WIBA), 2007 makes it compulsory for every employer in Kenya to insure their employees against work-related injury, occupational disease, and death. There is no exemption for size: a household with a single domestic worker, an SME with ten staff, and an industrial group with thousands all carry the same legal obligation. The employer is strictly liable for the scheduled benefits regardless of fault, and the Directorate of Occupational Safety and Health Services (DOSH) can issue a prohibition (stop-work) notice and prosecute an employer found operating without cover.

WIBA premiums are rated on your annual wage bill and your occupational class: an office attracts a far lower rate than a construction site or a transport fleet, so we quote it individually rather than a single starting figure. WIBA + Employers' Liability (Extended)

Adds common-law / Employers' Liability cover for negligence claims that fall outside the WIBA schedule, typically the larger awards for serious injury. Market standard and our default recommendation for any business beyond a single domestic worker.

Domestic WIBA (Households)

Real-World Scenarios

A new SME hires its first three employees

From the first hire the business is legally required to hold WIBA. On a modest payroll the premium starts small and is quoted against the actual wage bill: an office-based employer with a KSh 1,000,000 wage bill is looking at roughly KSh 7,000 a year before levies. Putting cover in place removes the personal liability the owner would otherwise carry and pre-empts a DOSH stop-work notice.

A site worker suffers a permanent hand injury

The insurer pays the medical treatment and a permanent partial disability lump sum, calculated as a percentage of annual earnings times the WIBA disability factor for that injury. If the worker also sues in negligence beyond the schedule, the Employers' Liability extension defends and indemnifies the business.

An employer is found operating without WIBA

DOSH can issue a prohibition notice halting work and prosecute the employer, who is then personally liable for the full scheduled benefits, which can run into millions for a serious injury or death. The premium saved is never worth that exposure; we place compliant cover the same day.

Is WIBA mandatory in Kenya?
Yes. The Work Injury Benefits Act, 2007 makes WIBA cover compulsory for every employer in Kenya, with no exemption for the number of employees. A household employing a single domestic worker is as legally bound as a large company. DOSH enforces compliance and can stop work and prosecute employers without cover.
How is the WIBA premium calculated?
The premium is rated on your annual wage bill (gross payroll) and your occupational class. Office and clerical staff attract a much lower rate than construction, manufacturing, or transport workers, so the rate varies too much by trade to publish a single figure. As a worked example, an office-based employer with a KSh 5,000,000 annual wage bill would pay in the region of KSh 35,000 a year for that staff, before levies and before any discount; the same wage bill on a construction site costs several times more. Most insurers adjust the final premium against your actual end-of-year payroll declaration.
What is the minimum WIBA premium?
For very small payrolls the premium falls to a modest minimum, which we confirm once we know your wage bill and occupational class. For a domestic household, WIBA is priced as a section of your home insurance policy rather than as a stand-alone minimum premium.
What is the difference between WIBA and Group Personal Accident?
WIBA is statutory cover for work-related injury, disease, and death, with benefits set by law and payable only for incidents arising out of employment. Group Personal Accident (GPA) is voluntary 24-hour cover (on- and off-duty) with benefits the employer chooses, often paying above the WIBA schedule. They are complementary, most strong benefits packages carry both, but GPA does not satisfy the legal WIBA requirement on its own.
Does WIBA cover occupational diseases as well as accidents?
Yes. WIBA covers occupational diseases, for example hearing loss, silicosis, or repetitive strain injury, where they arise out of the employment. The Act lists prescribed diseases, and others can be claimed with supporting medical evidence linking the condition to the work.
Do I need WIBA for casual and contract workers?
Yes. WIBA extends to casual, contract, and field-based workers provided they are declared in your payroll. We make sure the wording and declaration basis capture seasonal and casual labour so a claim is not declined for an undeclared worker.
What happens if I don't have WIBA and a worker is injured?
The employer becomes personally liable for the full WIBA-scheduled benefits, which can reach millions of shillings for a serious permanent injury or a death, plus any common-law claim. DOSH can also issue a stop-work notice and prosecute for non-compliance. Holding cover transfers that risk to an IRA-regulated insurer for a modest premium.
